Standard terms and conditions of Sprachstudio Leipzig

1. Scope of application

The following General Terms and Conditions (hereinafter referred to as "GTC") shall apply to the commissioning and execution of language lessons (hereinafter referred to as "course") between Sprachstudio Leipzig (hereinafter referred to as "Sprachstudio") and the course participant or prospective participant (hereinafter referred to as "customer"). The Sprachstudio's General Terms and Conditions shall apply exclusively; any terms and conditions of the Customer to the contrary are hereby expressly rejected.

2. Registration and conclusion of contract

2.1 Courses can be booked at any time either in person, by email or directly using the online booking form.

2.2 The online booking form can be used to book a specific course directly. When this form of booking is used, the customer will promptly receive an electronic booking confirmation. confirmation.

2.3 Irrespective of the booking method used in accordance with Section 2.1, Sprachstudio shall send the customer an invoice within three (3) days, containing in particular information on the language level, course dates and course fees, including the necessary payment details.

2.4. The contract shall be concluded and come into effect once the course fee has been credited to Sprachstudio's account in full in accordance with Section 3.1.

2.5. As soon as the customer's payment has been recorded, the customer will receive a final confirmation of registration by email, which can also be submitted to the embassy to apply for the necessary visa.

2.6. Once the maximum number of participants has been reached in accordance with Section 5.1, no other registrations will be accepted. In this case, Sprachstudio shall make all reasonable efforts to offer the customer a different course.

3. Terms of payment

3.1 Course fees are payable in full within fourteen (14) calendar days after the invoice has been sent. Payments can be made by bank transfer or in cash. In the case of a bank transfer, customers shall, in particular, specify their name, the course and the course dates to ensure the payment can be identified.

3.2 If the payment is not received within the time limit for payment specified in Section 3.1, the customer will no longer be entitled to the place on the booked course. In this case, Sprachstudio will be entitled to give the course place to another customer.

3.3 All fees associated with the payment – in particular for international bank transfers – shall be borne by the customer.

3.4 The payable course fee only covers the booked course. Textbooks and other working materials are not included in the price and must be purchased separately.

4. Right of withdrawal for consumers(*) for distance contracts and contracts concluded outside business premises. Cancellation policy

Right of withdrawal

You have the right to cancel this contract within fourteen days without giving any reason. The revocation period is fourteen days from the day of the conclusion of the contract. In order to exercise your right of withdrawal, you must inform us (Sprachstudio Leipzig, Lauchstädter Straße 15, 04229 Leipzig, Tel. +49 341 24732309, e-mail info@sprachstudio- leipzig.de) of your decision to withdraw from this contract by means of a clear declaration (e.g. a letter or e-mail sent by post). You can use the attached model cancellation form, which is not mandatory. If you make use of this option, we will send you confirmation of receipt of such revocation without delay (e.g. by e-mail). To meet the cancellation deadline, it is sufficient for you to send the notification of the exercise of the right of cancellation before the end of the cancellation period.

Consequences of the revocation

If you withdraw from this contract, we must refund all payments we have received from you immediately and at the latest within fourteen days of the day on which we received notification of your withdrawal from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees because of this repayment. If you have requested that the services begin during the withdrawal period, you must pay us a reasonable amount corresponding to the proportion of the services already provided up to the time you notify us of the exercise of the right of withdrawal with regard to this contract compared to the total scope of the services provided for in the contract.

(*) A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed.

5. Course and teaching conditions

5.1 The minimum age of the customers is 18 years. The maximum number of participants in a course is limited to eight (8). A lesson usually lasts 45 minutes.

5.2 An intensive course consists of twenty-four (24) units. However, If the maximum number of participants is not reached, the number of units can also be adjusted.

5.3 Sprachstudio reserves the right to make the final placement of a customer in a course dependent on an assessment of the customer's language skills on site.

5.4 While courses will be held at the agreed times, postponements are possible. Any postponements will be communicated to the customer in good time.

5.5 No lessons are held on public holidays. However, customers will have the opportunity to take a replacement class or take part in a replacement programme (e.g. excursion, sightseeing).

5.6 Sprachstudio reserves the right to cancel the course if there are insufficient registrations. In these circumstances, the customer will be offered an alternative date or a full refund of the course fee.

5.7 If the customer is unable to attend classes due to sickness, the customer shall notify Sprachstudio at the latest before the beginning of the class. This does not apply to booked private lessons. In this case, the sickness notification must be made the day before at the latest. Sprachstudio is under no obligation to offer catch-up classes for missed lessons.

5.8 A confirmation of attendance can be issued to the customer upon request, if the customer has attended at least eighty percent (80 %) of the classes.

5.9 Customers are not entitled to a specific lecturer. The designation of lecturers in the course programme is non-binding. If the lecturer is unable to attend class, Sprachstudio will endeavour to provide a replacement. However, if this is not possible, Sprachstudio will offer catch-up classes.

5.10 Customers shall comply with the course and house rules at the premises of Sprachstudio.

6. Rebooking and cancellation

6.1 Sprachstudio can usually rebook customers to the next course, provided that free places are available.

6.2 If the customer is unable to attend the booked course due to sickness or a delay in obtaining a visa, the contract can be suspended for a maximum of six (6) months. The customer shall provide Sprachstudio with documentary evidence relating to the sickness or delay in visa processing. If the customer is unable to take the course after six (6) months, the customer will lose their place in the course. In these circumstances, the customer will be offered a full refund of the course fee.

6.3 Where the customer takes a later course due to the reasons stated in Sections 6.1 and 6.2, Sprachstudio will be entitled to adjust the price of the course to reflect any price changes in the interim. Sprachstudio shall notify the customer accordingly, and the customer shall pay the difference in price.

6.4 The booked course can be cancelled by email without stating any reasons. Cancellations received up to eight (8) weeks before the start of the course are free of charge. For cancellations received up to four (4) weeks before the start of the course, Sprachstudio will be entitled to deduct a cancellation fee of 25% of the course fee. For cancellations received up to one (1) week before the start of the course, Sprachstudio will be entitled to deduct 50% of the course fee. Customers are not entitled to the refund of course fees for cancellations received after the start of the course.

6.5 The relevant date for the cancellation is the date on which Sprachstudio receives the cancellation notification (e-mail).

6.6 The customer shall bear any transfer fees that may arise in connection with the refund of the course fees already paid – whether in accordance with Section 6.2 or 6.4. These will be deducted by Sprachstudio directly from the refund amount.

6. Special information for customers

6.1 Customers shall be responsible for ensuring at their own expense that their stay in Germany is lawful and that they have the necessary visa, entry or residence permits. Sprachstudio expressly points out in this context that visa processing may take some time (up to 3 months).

6.2 Customers shall be responsible for taking out health insurance valid in Germany and, if applicable, other insurance policies (in particular, accident and/or liability insurance). Sprachstudio does not accept any liability for this area.

7. Interruption, postponement, online course

Sprachstudio reserves the right to change, postpone or interrupt course dates and the form of instruction (e.g. face-to-face training to online course) for important reasons while safeguarding the interests of the customer. Important reasons are in particular force majeure (natural disaster, pandemic, riot) or official orders. The customer will be informed about the change, as far as possible, in time. In this case, he/she must ensure that he/she has the necessary technical prerequisites to participate in the online lessons. There is no right of withdrawal; the obligation to pay continues to exist.

8. Special instructions for customers

8.1. Customers shall be responsible for ensuring at their own expense that their stay in Germany is lawful and that they have the necessary visa, entry or residence permits. Sprachstudio expressly points out in this context that visa processing may take some time (up to 3 months).

8.2. Customers shall be responsible for taking out health insurance valid in Germany and, if applicable, other insurance policies (in particular, accident and/or liability insurance). Sprachstudio does not accept any liability for this area.

9. Liability and compensation

9.1. Claims for damages against Sprachstudio on whatever legal basis are excluded, unless Sprachstudio, its legal representatives or vicarious agents act with intent or gross negligence or the claim for damages is based on a breach of material contractual obligations. In the latter case, Sprachstudio's liability for negligence is limited to foreseeable, typical damage. This does not prejudice Sprachstudio's liability for damage suffered as a result of injury to life, body or health.

9.2. Any contractual and tortious claims of the customer beyond those in clause 9.1. are excluded. Sprachstudio is, in particular, not liable for failure to achieve a certain learning result. The requirements for achieving the course objective are based on many years of experience and may deviate in individual cases from the actually acquired knowledge. This applies mutatis mutandis to the loss of private property within or outside Sprachstudio's premises.

10. Data protection

10.1 Sprachstudio collects, processes and uses personal data of the customer in particular on the basis of consent, for the conclusion and fulfillment of the contract, on the basis of legal obligations or a legitimate interest.

10.2 The customer hereby agrees that these data are collected and processed for purposes of the proper performance of services. Where Sprachstudio intends to use personal data also for advertising or social media purposes, it shall ask the customers for their consent in advance.

10.3 For further information on data protection, please refer to Sprachstudio's privacy policy, to which we explicitly refer here. Customers are entitled to object to the use of their data at any time by sending their objection by email with the words "data protection" in the subject line to info@sprachstudio-leipzig.de.

11. Final provisions

11.1 All contracts concluded under these standard terms and conditions are governed and shall be construed solely in accordance with the laws of the Federal Republic of Germany.

11.2 To the extent permissible by law, the place of jurisdiction is Leipzig, Germany.

11.3 If any provision of these standard terms and conditions is or becomes invalid, whether in whole or in part, the validity and enforceability of the remaining provisions of this agreement will not be affected or impaired thereby. The invalid provision shall be replaced to the extent permissible by law by a provision that comes closest to the content and economic effect of the original provision Sprachstudio and the customer would have agreed upon had they been aware of the invalidity of the provisions.

11.4 In the case of any doubts or disputes over the meaning or interpretation of any provision of the English version of these standard terms and conditions, the German version shall prevail.
